These terms govern your use of BuyerPanel ("BuyerPanel", "we", "us"). By creating an account or using the service, you agree to them. Please read them together with our Privacy Policy.
BuyerPanel helps you generate advertising creative, pre-test it against a synthetic buyer panel, and analyze and optimize ad campaigns. Features rely on third-party AI and advertising platforms, which you connect using your own API keys and accounts.
You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. You must be at least 16 years old and able to enter into a contract.
BuyerPanel is "bring your own key". You are responsible for your own accounts with AI and ad providers (Anthropic, Voyage, OpenAI, fal.ai, HeyGen, Meta and any others), including all usage, fees, and compliance with their terms. By adding a key, you authorize BuyerPanel to use it to perform the actions you request. You can remove a key at any time.
Content generated or scored by AI (ad copy, images, video scripts, purchase-intent scores, optimization recommendations) may be inaccurate, incomplete, or unsuitable, and does not constitute professional marketing, legal, financial, or tax advice. You are responsible for reviewing all output before using or publishing it. You are responsible for ensuring your ads are truthful and lawful.
You agree not to: use the service for unlawful, deceptive, or infringing purposes; create ads that violate applicable law or platform policies; attempt to breach security, reverse engineer, resell, or copy the platform; or interfere with others' use of the service.
You own the content you create and the rights you hold in your inputs and outputs, and you are responsible for them. You grant us the limited rights needed to operate the service for you (for example, storing your projects and passing content to the providers you configured). We own the BuyerPanel platform, software, and brand; nothing here transfers those rights to you. Our software is proprietary and may not be copied or redistributed.
Some actions consume credits. During early access the service may be provided free or with promotional credits. If paid plans are enabled, prices and terms will be shown before you buy, and payments are processed by our payment provider. Except where required by law, fees are non-refundable. Costs you incur with your own AI and ad providers are separate and are yours.
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. BuyerPanel is not a marketing agency, advertising platform, or financial, legal, or tax advisor.
To the fullest extent permitted by law, BuyerPanel is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost data, or wasted ad spend. Nothing in these terms limits liability that cannot be limited by law. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the 12 months before the claim.
You agree to indemnify BuyerPanel against claims arising from your content, your ads, your use of connected platforms, or your breach of these terms, to the extent permitted by law.
You may stop using the service and delete your account at any time. We may suspend or terminate access if you breach these terms or to protect the service or other users. On termination, the rights granted to you end; sections that by their nature should survive (e.g. IP, disclaimers, limitation of liability) continue.
These terms are governed by the laws of the operator's country of establishment, and disputes are subject to the competent courts there, without prejudice to mandatory consumer protections that apply where you live. Operator: fill in your legal entity name and country before public launch.
We may update these terms as the product evolves. We will update the date above and, for material changes, take reasonable steps to notify you. Continued use after changes means you accept them.
